Guardian Alpha Terms of Use Agreement

Welcome to Guardian Alpha (the “Application”). By accessing or using this Application, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the Application.
1. Eligibility
You must be at least 18 years old to use Guardian Alpha.
By using the Application, you confirm that you meet this age requirement.
2. No Medical Advice – Informational Use Only
Guardian Alpha is an informational tool designed to provide general health insights based on user-provided data and wearable technology inputs.
Guardian Alpha does NOT provide medical advice, diagnoses, or treatments.
Explicit Emergency Disclaimer
Warning: DO NOT use Guardian Alpha as a substitute for emergency medical care. If you experience:
✅ Chest pain
✅ Difficulty breathing
✅ Confusion
✅ Severe headache
✅ Sudden weakness or numbness
✅ Loss of consciousness
Call 911 or seek emergency medical assistance immediately.
3. No Doctor-Patient Relationship
By using Guardian Alpha, you acknowledge and agree that:
✅ The concerns, recommendations, and explanations provided are for educational purposes only and are not a substitute for professional medical evaluation, diagnosis, or treatment.
✅ You should always consult a licensed healthcare professional before making any health decisions based on the Application’s outputs.
✅ Guardian Alpha does not create a doctor-patient relationship between you and its developers, operators, or affiliates.
4. Technology, Data Use & Limitations
A. How Guardian Alpha Works
Guardian Alpha uses AI-based models to generate insights based on your symptoms, medical history, location, and wearable technology data (e.g., Apple Watch).
AI-generated outputs are subject to limitations, data delays, and inaccuracies.
B. Surveillance Mode Limitations
Guardian Alpha does NOT provide real-time health monitoring.
Data from wearable devices may be delayed or inaccurate due to manufacturer limitations.
Guardian Alpha analyzes sleep-time vital signs but does not continuously monitor health throughout the day.
If you are experiencing symptoms, you should manually enter real-time vital signs for the most relevant insights.
C. No Guarantee of Accuracy
By using Guardian Alpha, you acknowledge that:
✅ The Application’s outputs may be incomplete, inaccurate, or subject to machine-learning limitations.
✅ Recommendations are based on aggregate trends and should never replace professional medical advice.
✅ Some wearable devices provide FDA-approved measurements, while others do not—impacting data accuracy.
✅ The accuracy of biometric readings depends on proper use and positioning of the wearable device. Guardian Alpha is not responsible for inaccuracies due to improper use or manufacturer limitations.
5. Purpose and Limitations
Guardian Alpha is designed to:
✅ Help users recognize potential health concerns early
✅ Encourage proactive medical evaluation
✅ Provide general health insights
However, Guardian Alpha CANNOT:
❌ Diagnose medical conditions
❌ Prescribe medications or treatments
❌ Guarantee medical accuracy or completeness
❌ Prevent, treat, or cure any disease
Users Must Always Seek Medical Advice
You are strongly advised to consult a licensed healthcare professional for any health concerns, regardless of the Application’s recommendations.
6. User Responsibilities
By using Guardian Alpha, you accept full responsibility for your health decisions. Specifically, you agree that:
✅ You are solely responsible for verifying any AI-generated insights with a healthcare provider.
✅ You will not rely on Guardian Alpha for critical or emergency medical decisions.
✅ You assume all risks associated with using the Application.
7. Limitation of Liability
To the fullest extent permitted by law:
Guardian Alpha, its developers, affiliates, officers, employees, and agents shall NOT be held liable for any injury, harm, damages, losses, or legal claims—whether direct, indirect, incidental, consequential, or otherwise—arising from your use of the Application.
This includes, but is not limited to:
✅ Misinterpretation of AI-generated recommendations
✅ Delays in seeking medical attention
✅ Reliance on inaccurate or outdated data
✅ Wearable device malfunctions or limitations
✅ Errors in biometric data due to improper device usage
✅ Users Waive All Legal Claims Against Guardian Alpha
By using this Application, you fully release and discharge Guardian Alpha and its affiliates from any claims, liabilities, or damages resulting from your use of the Application.
8. Indemnification
You agree to indemnify and hold harmless Guardian Alpha, its affiliates, officers, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising out of:
✅ Your use of the Application
✅ Your reliance on any AI-generated insights
✅ Your breach of these Terms of Use
9. Changes to the Terms of Use
Guardian Alpha reserves the right to modify or update these Terms at any time.
✅ Continued use of the Application after updates are made constitutes acceptance of the revised Terms.
✅ It is your responsibility to review the Terms periodically for any changes.
10. Governing Law & Dispute Resolution
These Terms of Use shall be governed by the laws of Kansas, USA.
Mandatory Arbitration Clause
✅ Any disputes must be resolved through binding arbitration, not litigation.
✅ Arbitration will be conducted in Kansas, USA, in accordance with the American Arbitration Association (AAA) rules or another mutually agreed-upon arbitration service.
✅ Both parties waive the right to a jury trial or participation in a class action lawsuit.
If any portion of this arbitration clause is found to be unenforceable, the remaining provisions shall remain in full effect.
11. Consent Agreement – Mandatory User Acknowledgment
Before accessing Guardian Alpha, users must actively acknowledge the following:
✅ “I understand that Guardian Alpha does not provide medical advice, diagnosis, or treatment.”
✅ “I agree to seek medical attention from a licensed provider for any health concerns.”
✅ “I assume full responsibility for my health decisions and waive all legal claims against Guardian Alpha.”
